The Ball is in the center. It is this Friday, July 24, 2020 that opens at the Court of Appeal of Kinshasa, Gombe the appeal trial of Vital Kamerhe and his co-accused, the Lebanese Samih Jammal, both sentenced in the first degree to the maximum penalty. 20 years of forced labor by the Kinshasa,Gombe tribunal de grande instance, for embezzlement of public funds as part of the 100-day program in its component of “prefabricated houses”. This is accompanied by a few ancillary penalties, in particular the sentence to 5 years of ineligibility.
For this first meeting, the group of lawyers of the director of the “prevented” cabinet of the Head of State who does not intend to abdicate, says he is confident and waits for the appeal judge to note the defects in the judgment rendered in first degree.
This was revealed the day before the opening of the trial, Maître Jean-Marie Kabengela Ilunga, a member of the Congolese lawyers collective of Vital Kamerhe, on Top Congo radio. “The trial is confirmed for this Friday on appeal so that the Court can examine the appeals of the defendants as well as those sentenced to special confiscation of their property,” he said.
Not satisfied with the verdict pronounced in the first degree, Maître Kabengela Ilunga intends to see the judge of the Court of Appeal of Kinshasa at Gombe re-examine the things and to note the vice of the judgment rendered by the tribunal de grande instance of Kinshasa / Gombe and proceed as right.
Namely, this member of the defense collective of Vital Kamerhe had already announced the day following the judgment of the TGI at Gombe that their client should appeal in order to obtain the reform of what he considered as “bad judgment. surrendered ”, before releasing in parable“ Vital Kamerhe lost a battle, and not the war ”.
For him, the judgment was poorly delivered despite the fact that the judge not only developed poor motivation, but above all was unable to demonstrate that Vital Kamerhe had signed a document attesting that he had received money. , allegedly hijacked.
What about the duration of this appeal trial?
As a legal practitioner, this man in a two-tone gown informs that the duration of this case before the Kinshasa / Gombe Court of Appeal will depend only on the questions which will require the reconsideration of the file on appeal. And for the rest, he blurted, the appreciation stems from the judge’s inner conviction.
